These Terms of Service ("Terms") govern your access to and use of Stream-Wiser ("Service"), operated by Stream-Wiser ("we," "us," or "our"). By accessing or using the Service, you confirm that you are at least 13 years of age and agree to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Stream-Wiser is an AI-powered streaming subscription optimizer that helps you manage and plan your streaming service subscriptions. The Service analyzes your watchlist and viewing preferences to generate personalized 12-month subscription calendars and recommendations. Features include:

• Watchlist and viewing history tracking
• AI-generated subscription optimization recommendations
• Streaming provider comparison and scheduling tools
• Insights and analytics on your streaming habits
• Optional premium subscription ("Pro") with expanded features

3. Accounts and Registration

To access certain features you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your password and account
• Promptly notify us of any unauthorized account access
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Free and Paid Plans

Stream-Wiser offers a free tier with limited features and a paid Pro subscription. Paid subscriptions are billed on a recurring basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on the applicable billing cycle.

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Scrape, crawl, or systematically extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its systems
• Transmit any harmful, offensive, or disruptive content
• Use the Service for any commercial purpose without our written consent

6. Third-Party Services and Data

Stream-Wiser integrates with third-party services including:

• TMDB (The Movie Database) — for movie and TV show metadata. Data is provided by TMDB and subject to their terms.
• Supabase — for secure data storage and authentication.
• Stripe — for payment processing. Your payment information is handled directly by Stripe and not stored on our servers.
• Google — if you sign in with Google, you authorize us to access your basic profile information.

We may display affiliate links to streaming services. We may earn a commission when you subscribe through these links, at no additional cost to you.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Stream-Wiser and are protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Content you submit (such as your watchlist data) remains yours. You grant us a limited, non-exclusive license to use that content solely to provide and improve the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. STREAMING AVAILABILITY AND PRICING ARE SUBJECT TO CHANGE BY THE RESPECTIVE PROVIDERS AND MAY NOT ALWAYS BE ACCURATE.

Recommendations generated by our AI are for informational purposes only and do not constitute financial or subscription advice.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STREAM-WISER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Stream-Wiser and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date above and, where appropriate, by email or in-app notice. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
